Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BOOM web site and mobile application ("Service"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Service. Some community features may require verification of enrollment at a participating educational institution. By using the Service, you represent and warrant that you meet these eligibility requirements.

2. User accounts & content

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You retain ownership of the content you submit to the Service.

Content License: By posting or uploading any content to BOOM, you grant BOOM a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display such content in connection with operating, promoting, and improving the Service. This license includes the right to share your content on other platforms, social media, marketing materials, and third-party services to promote BOOM and the community.

You represent and warrant that you own or have the necessary rights to the content you post, and that your content does not violate any third-party rights or applicable laws.

3. Anonymous participation

BOOM provides privacy-forward features including anonymous avatars and pseudonymous participation in public discussions. While your identity may be hidden from other users, BOOM may retain identifying information as required by law or to enforce these Terms. Abuse of anonymity features may result in account suspension or termination.

4. Marketplace & transactions

BOOM may facilitate buy/sell/swap transactions between users. All such transactions occur directly between users. BOOM acts solely as a platform and is not responsible for items exchanged, payment disputes, fulfillment, or the conduct of buyers or sellers. Exercise caution when transacting with other users.

5. Prohibited conduct

You agree not to: post illegal, harmful, threatening, abusive, harassing, defamatory, or obscene content; impersonate any person or entity; post content that infringes intellectual property rights; share personal data of others without their consent; attempt to gain unauthorized access to the Service or other accounts; use the Service for any fraudulent or deceptive purposes; interfere with or disrupt the Service; collect user information without consent; or post spam or unauthorized promotional content.

Violation of these rules may result in content removal, account suspension, or termination.

6. Moderation & reporting

BOOM provides reporting tools and may remove content or suspend accounts at its sole discretion. We do not guarantee immediate action on reports but will investigate serious violations.

7. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

8. Intellectual property

The Service and its original content (excluding user-generated content), features, and functionality are owned by BOOM and are protected by copyright, trademark, and other intellectual property laws.

9. Disclaimers & limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BOOM DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY IS LIMITED TO THE GREATER OF $100 USD OR AMOUNTS PAID BY YOU TO BOOM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless BOOM, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing law

These Terms shall be governed by and construed in accordance with the laws of Hong Kong SAR, without regard to its conflict of law provisions.
